1. Acceptance of Terms
By accessing or using the Momentum platform, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our service.
2. Description of Service
Momentum is an AI-powered social media management platform that generates, schedules, and publishes content across Instagram, Facebook, and LinkedIn on behalf of businesses. The service includes content generation, brand voice training, content calendars, analytics, and team collaboration tools.
3. Account Registration
You must provide accurate, complete, and current information when creating an account. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.
4. Subscription and Billing
Paid subscriptions are billed on a monthly or annual basis at the rate agreed upon during onboarding. You authorize us to charge your designated payment method on a recurring basis. We reserve the right to modify pricing with 30 days' notice.
5. Acceptable Use
You agree not to use Momentum to generate, distribute, or publish content that is unlawful, harmful, defamatory, obscene, or otherwise objectionable. We reserve the right to suspend or terminate accounts that violate this policy.
6. Intellectual Property
The Momentum platform, including its software, design, logos, and documentation, is the exclusive property of Momentum and is protected by intellectual property laws. AI-generated content created through the platform is owned by you upon publication.
7. User Content
You retain ownership of all content you upload, create, or publish through Momentum. By using our service, you grant us a limited license to process, store, and transmit your content solely for the purpose of providing the service.
8. Limitation of Liability
To the maximum extent permitted by law, Momentum shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.
9. Termination
You may cancel your subscription at any time. We may terminate or suspend your account immediately for conduct that violates these terms. Upon termination, your data will be retained for 30 days before deletion.
10. Governing Law
These terms shall be governed by and construed in accordance with the laws of Switzerland. Any disputes shall be resolved exclusively in the courts of the Canton of Vaud, Switzerland.
